Financial Criteria

If you cannot afford to pay the fees for filing an appeal, you can apply to the court under Rule 85 for an order that no fees are payable. This order only exempts you from paying court filing fees. Usually, an application for such an order is made at the same time as the filing of the notice of appeal.

The registrar has set the criteria below for the purposes of identifying financial circumstances in which the payment of court fees would cause undue financial hardship (see Rule 85(2)).

Income criteria:

  • 1-3 member household: gross annual household income of $60,000 or less
  • 4+ member household: gross annual household income of $84,000 or less
