
The Court of Appeal issues Civil Practice Directives pursuant to the Court of Appeal Rules. They are intended to provide guidance in the conduct of an appeal and enable the Court to regulate and control its procedure. Practice Directives do not have the same force of law as the formal enactments in the Court of Appeal Act and Rules, but they express the view of the Court regarding matters of practice in the conduct of an appeal. Litigants and practitioners are expected to review and comply with practice directives or show good reason for doing otherwise.
On 18 July 2022, the Court will rescind a number of practices directives, notes and notices as part of the transition to the new Court of Appeal Act and Rules. Some practice directives are being updated, some are incorporated into the new Rules, two new practice directives will be issued (styles of proceedings and appearing remotely and appearing remotely). The registrar will also issue a new filing directive.
