NEW PRACTICE DIRECTIONS

Chief Justice Bauman issued two new practice directions today as a result of the coming into force of the Family Law Act.

  • PD-42 - Masters Jurisdiction

This practice direction authorizes masters to issue a number of interim orders under the Family Law Act.  PD-42 replaces PD-34.

  • FPD-12 - Judicial Case Conferences

This practice direction has been updated to take account of the relevant Family Law Act provisions. FPD-12 replaces FPD-4.

Effective Date

PD-42 - Masters Jurisdiction and FPD-12 - Judicial Case Conferences come into force today.

NEW PRACTICE DIRECTION - DIVORCE APPLICATIONS

Chief Justice Bauman issued FPD -11 Divorce Applications today.

FPD-11 Divorce Applications replaces FPD-8 Divorce Applications which was rescinded on March 18, 2013. In error, notice given yesterday indicated that FPD-8 would not be replaced.

NEW PRACTICE DIRECTIONS - FAMILY LAW ACT

Chief Justice Bauman issued two new practice directions today as a result of the coming into force of the Family Law Act.

NEW FAMILY PRACTICE DIRECTIONS

  • FPD-9 - Return Applications pursuant to 1980 Hague Protocol - Procedural Requirements

This practice direction has been updated to take account of the relevant Family Law Act provisions. FPD-9 replaces FPD-5.

  • FPD-10 - Standard Directions for Appeals from Provincial Court - Family Law Act

This practice direction has been updated to take account of the relevant Family Law Act provisions. FPD-10 replaces FPD-7.

EFFECTIVE DATE

All of the new practice directions come into force on March 18, 2013.

FUTURE PRACTICE DIRECTIONS

The Family Law Act also requires changes to PD-34 - Masters Jurisdiction and FPD-4 - Judicial Case Conferences. It is anticipated that these practice directions will be reissued on March 25, 2013.

ELECTRONIC NOTIFICATION PROCESS - RELEASE OF WRITTEN REASONS FOR JUDGMENT - MAR. 26, 2013

Effective March 26, 2013, the Supreme Court will begin implementing a new electronic notification system to advise counsel and parties that Reasons for Judgment will be released. This new process will replace the time consuming process of the Reserve Judgment Office contacting counsel and parties by telephone the day before the release of the Reasons for Judgment. For more information about the new process, please see the Notice issued by Chief Justice Bauman which is available here.

NEW FAMILY LAW ACT AND REVISED SUPREME COURT FAMILY FORMS

The new Family Law Act takes effect on March 18, 2013 and will replace the existing Family Relations Act. Some changes to the Supreme Court Family Forms will also come into effect on March 18, 2013 to reflect the new Family Law Act. The new forms are now available on the Ministry of Justice website. You can access them here.

Please note that the forms will be located at this URL for this week only. On Monday, March 18th, the new/revised forms will replace the existing forms which refer to Family Relations Act and will be available at: http://www.ag.gov.bc.ca/courts/other/supreme/2010SupRules/info/index_family.htm

WELCOMING CEREMONY - MR. JUSTICE BAIRD AND MR. JUSTICE THOMPSON - MARCH 22, 2013

The Welcoming Ceremony for the Honourable Mr. Justice Robin A. M. Baird and Mr. Justice Douglas W. Thompson will be held on Friday, March 22, 2013 at the Nanaimo Law Courts at 4:15 p.m. in Courtroom 232. Members of the public are invited to attend the Welcoming Ceremony.

The Supreme Court of British Columbia announces that the Honourable Mr. Justice Robert W. Metzger retired from the Supreme Court at Victoria on January 31, 2013.

JUDICIAL RETIREMENT - THE HONOURABLE MR. JUSTICE WILLIAMSON

The Supreme Court of British Columbia announces that the Honourable Mr. Justice Paul Williamson retired from the Supreme Court at New Westminster on January 31, 2013.

PRACTICE DIRECTION - 41 - RESTORATION APPLICATIONS FOR COMPANIES AND SOCIETIES -
FEBRUARY 4, 2013


Chief Justice Bauman issued PD - 41 - Restoration of Companies and Societies pursuant to Business Corporations Act and Society Act which describes the application process for restoring a company under the Business Corporations Act, S.B.C. 2002 c, 57 or a society under the Society Act, R.S.B.C. 1996, c. 433. PD-41 was issued because of recent amendments to the Society Act which include specific provisions for restoring societies. PD-41 which rescinds PD-19 takes effect on February 4, 2013.

JUDICIAL RETIREMENTS

The Supreme Court of British Columbia announces that the Honourable Mr. Justice Victor R. Curtis retired from the Supreme Court at Vancouver on December 31, 2012 and that the Honourable Mr. Justice Robert E. Powers retired from the Supreme Court at Kamloops on January 7, 2013.

CHAMBERS ASSIZE PILOT PROJECT - VANCOUVER - JANUARY 7, 2013

Chief Justice Bauman announced the commencement of a pilot project at Vancouver Law Courts to ameliorate the increase in the number of long chambers applications in civil (non-family) proceedings which are not heard as scheduled. The pilot project involves the creation of a chambers assize the details of which are available here.
