Model Orders

With PD-47 - Model Orders, the Court has prescribed the use of model forms of orders for certain types of orders. The purpose of the model orders is to encourage parties and the Court to focus on the issues in dispute in a particular proceeding.

Despite the direction for the use of model forms of order in certain proceedings, an applicant must, as with any application for any relief, satisfy the Court that the relief provided in the model form of order is appropriate in the circumstances of the particular proceeding.

Where an applicant seeks relief that is different than that provided in the model form of order, the applicant must identify the differences by providing a black line copy of the order sought as compared to the model order and explain the reason why the order should be granted on terms different from those provided in the model order.

From time to time, the Court may revise the terms of the model orders, issue new model orders or rescind existing model orders. As amendments are made, new model orders issued or existing model orders rescinded, the list of model orders on this page will be updated. This website will always have the current forms of all of the Court’s model orders.
